These Terms and Conditions (“Terms”) govern your use of hoffmanwatches.com and purchases from HWOSAB LLC, doing business as HOFFMAN (“we,” “us,” or “our”).
By using our website or placing an order, you agree to these Terms and the policies incorporated into them. Nothing in these Terms limits any consumer right that cannot lawfully be limited or waived.
SECTION 1 - PRODUCTS AND ORDERS
We make reasonable efforts to describe and display our products accurately. Colors may vary by screen, and measurements, finishes, materials, and other specifications may contain reasonable manufacturing variations.
Submitting an order is an offer to purchase. An automated order confirmation acknowledges receipt but does not mean we have accepted the order. We ordinarily accept an order when we send a shipping confirmation or otherwise expressly confirm acceptance.
We may reject or cancel an order because of product unavailability, an obvious pricing or description error, payment problems, suspected fraud, an incorrect address, legal restrictions, announced quantity limits, or suspected unauthorized resale. If we cancel after collecting payment, we will refund the cancelled amount to the original payment method.
Our website is intended for sales to individual consumers. Products may not be purchased for commercial resale without our prior written authorization. This does not prevent the lawful resale of a product originally purchased for personal use.
SECTION 2 - PRICES, PAYMENT, TAXES, AND DUTIES
Prices are shown in the currency selected on the website. A price change will not affect an order we have already accepted.
The product price and any applicable shipping charges will be displayed before you complete your order.
For international orders, the recipient is responsible for import taxes, value-added taxes, customs duties, brokerage fees, and other governmental charges not collected by us.
Currency-conversion rates and related fees may be determined by Shopify, a payment processor, your card issuer, or another financial institution.
You represent that you are authorized to use the submitted payment method. We may verify payment and take reasonable measures to prevent fraud.
If a price or promotion is obviously incorrect, we may reject or cancel the affected order before acceptance. Any amount collected will be refunded.
SECTION 3 - SHIPPING AND DELIVERY
Shipping methods, estimated delivery times, and charges are described on our Shipping page.
Processing and delivery dates are estimates unless we expressly guarantee a date. Delivery may be affected by carriers, customs, weather, public emergencies, incorrect address information, or other circumstances outside our reasonable control.
Title to and risk of loss pass to you when the order is delivered to the address provided at checkout, except where applicable law provides otherwise.
Please report a damaged or missing package to contact@hoffmanwatches.com as soon as reasonably possible. We may request photographs, packaging, tracking information, or other reasonable documentation to investigate the claim.
You are responsible for providing an accurate delivery address. Additional costs caused by an incorrect address, an unclaimed shipment, or a refused delivery may be deducted from a refund to the extent permitted by law.
Our Shipping page is incorporated into these Terms.
SECTION 4 - RETURNS AND REFUNDS
Unless identified as final sale before purchase, an eligible new and unused product may be returned under the terms on our Returns page within 14 days after delivery.
Returned products must be undamaged, unworn, and complete, with all original packaging, accessories, manuals, labels, protective stickers, and other protective materials intact.
Removing or altering a protective sticker causes a watch to be treated as used because it can no longer be sold as new. A watch with a removed or altered protective sticker is not eligible for a change-of-mind return, except where applicable law provides otherwise.
Do not return a product until we have authorized the return. If an ineligible product is returned, we may reject the return and offer to send it back. The customer may be responsible for the cost of that shipment to the extent permitted by law.
At our discretion, we may accept a product with removed or altered protective stickers and deduct an amount reasonably reflecting its reduction in value. We will explain any deduction before completing the refund.
We may otherwise reduce or deny a change-of-mind return if a product has been used, damaged, altered, or returned incomplete, except where applicable law provides otherwise.
For eligible US returns, we will provide instructions and, where stated on our Returns page, a prepaid return label.
International customers are generally responsible for return shipping and related customs or brokerage charges, except where a product is defective, damaged, incorrect, or applicable law provides otherwise.
Refunds are issued to the original payment method after the returned product has been received and inspected. Payment-processor timelines may affect when the refund appears.
Protective-sticker and return-condition restrictions do not affect rights concerning products that are defective, damaged, incorrect, materially misdescribed, undelivered, or otherwise subject to a remedy under applicable law.

SECTION 5 - LIMITED PRODUCT WARRANTY
Our watches are covered by a 24-month Limited Watch Warranty against defects in materials and workmanship under normal use, beginning on the original purchase date.
Unless stated otherwise on the applicable product page, this warranty does not apply to straps, bracelets, batteries, watch rolls, tools, packaging, or other accessories. Accessories remain eligible for remedies required by applicable law if defective, damaged, incorrect, or materially misdescribed when delivered.
The warranty does not cover ordinary wear and tear, aging, scratches, discoloration, stretching, worn finishes, deterioration from normal use, accidental damage, misuse, improper care, unauthorized repairs, or failure to follow applicable instructions.
Water damage is not covered when it results from use exceeding the product’s stated water-resistance rating or failure to follow applicable instructions.

Our written warranty does not limit rights or implied warranties that cannot lawfully be limited. You may have additional rights that vary by state or jurisdiction.
SECTION 6 - WEBSITE USE, INTELLECTUAL PROPERTY, AND PRIVACY
The website and its contents—including HOFFMAN trademarks, product names, photographs, designs, text, graphics, and layouts—are owned by or licensed to us and protected by applicable law.
You may use the website for lawful, personal purposes. You may not commercially exploit its content, misuse our trademarks, interfere with its operation or security, introduce harmful code, obtain unauthorized access, impersonate another person, or use it for fraud or other unlawful conduct.
Our Privacy Policy governs our collection, use, and disclosure of personal information.
The website may link to or integrate with third parties, including Shopify, payment processors, carriers, and social-media platforms. Their own terms and privacy policies may apply.
Products may not be purchased, exported, or transferred in violation of applicable US trade-sanctions or export-control laws.
SECTION 7 - DISCLAIMERS AND LIMITATION OF LIABILITY
We try to keep the website accurate, secure, and available but do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law, the website and its general informational content are provided “as is” and “as available.”
These disclaimers do not affect our Limited Watch Warranty, rights concerning defective or misdescribed products, applicable product-liability law, or any other right that cannot lawfully be waived.
Nothing in these Terms excludes or limits liability for fraud, gross negligence, willful misconduct, death or personal injury caused by negligence or a defective product, or any liability that applicable law does not permit us to exclude or limit.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, punitive, or consequential damages that were not reasonably foreseeable or caused by our breach.
Except for obligations under an applicable written warranty, returns or refunds provided by these Terms, and liabilities that cannot lawfully be limited, our aggregate liability arising from a product purchase will not exceed the amount paid for that product.
Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.
SECTION 8 - GOVERNING LAW AND GENERAL TERMS
These Terms and disputes arising from them, the website, or a purchase are governed by Delaware law, without regard to conflict-of-law principles.
Subject to any non-waivable consumer right, the state and federal courts located in Sussex County, Delaware will have jurisdiction over disputes arising from these Terms. Either party may bring an eligible individual claim in small claims court.
Nothing in these Terms waives a mandatory right relating to defective or unsafe products, implied warranties, unfair or deceptive practices, required refunds, product liability, privacy, or access to courts or government agencies.
We may update these Terms by posting a revised version with a new effective date. Changes apply prospectively and do not alter an order already accepted unless required by law or agreed with the customer.
If a provision is found unlawful or unenforceable, the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver.
These Terms, together with our Privacy Policy, Shipping, Returns, and Warranty pages, and any terms expressly presented with an order, form the agreement concerning the website and your purchase.
Terms expressly agreed to for a particular order take priority. For warranty coverage and remedies, the Warranty page controls.
